Terms and conditions of sale

These general terms and conditions of sale apply to all orders and purchases made on the www.meelaq.ch website operated by Meelaq, and govern the relationship between Meelaq and the purchaser (hereinafter the Customer).

By placing an order with Meelaq, the Customer accepts the application of these general terms and conditions of sale.

Meelaq reserves the right to modify the terms, conditions and mentions of the present general sales conditions. These modifications are deemed to have been accepted without reservation as soon as you access the site after they have been put on line.

The terms "we", "us" and "our" in these terms and conditions and throughout this site refer to "Meelaq".

Control

Meelaq only accepts orders from Customers whose registered office or place of residence is in Switzerland.

By placing an order with Meelaq, the Customer declares that he/she has full civil rights. All persons under 18 years of age must have the authorization of their parent or guardian to order.

When the customer clicks on the "Order" button, the order is considered binding for all items in the shopping basket. A sales contract within the meaning of Articles 197 et seq. of the Swiss Code of Obligations thus comes into effect immediately, and is governed by the present terms and conditions.

Meelaq is not obliged to deliver items when we are unable to obtain the items from our suppliers (delivery delays, products sold out, etc.). In this case, Meelaq will immediately reimburse the customer.

Meelaq reserves the right to refuse an order in cases of risk of fraud or non-payment.

Price

All prices are quoted in Swiss francs (CHF) and include the applicable value-added tax (VAT). Payments must be made in Swiss francs (CHF).

Meelaq reserves the right to modify the price of the products offered at any time. Once the order has been validated, the price cannot be modified.

Payment

Meelaq offers the following online payment methods: Twint - Visa - Mastercard - Postcard - E-finance.

The Customer guarantees to be the owner of the means of payment used. In the event of fraudulent use, Meelaq cannot be held liable.

By placing an order with Meelaq, the Customer expressly authorizes Meelaq to verify the Customer's solvency with a third party.

Shipping & Delivery

Items are dispatched by Swiss Post within 2 to 5 working days. Delivery times are indicative and non-binding. Meelaq declines all responsibility for any delay in delivery due to postal services.

Delivery is free throughout Switzerland.

In the case of multiple orders, Meelaq reserves the right to group the items in a single mailing.

Undelivered shipments returned to Meelaq are subject to applicable shipping and return charges. In the event of an undelivered shipment returned to Meelaq, the order will be considered cancelled and the merchandise will be reclaimed. The sales price will be refunded to the Customer, less shipping and return costs.

Product verification

The Customer must immediately inspect the products and notify Meelaq of any defects or damage within 2 days of receipt. In the absence of notification by the Customer within the aforementioned period, the products are deemed to have been received in good condition, without defect or damage and accepted as is, with the exception of non-apparent defects.

Returns & Refunds

In accordance with the legal provisions in force, the Customer has a period of 7 working days (as evidenced by the postmark), following receipt of the package, to
return the order. After this period, the product will not be accepted and no refund or exchange will be possible.

Products must be returned complete in their original packaging (including boxes, labels and accessories). They must be new, unused, unwashed and unstained. Any product not complying with these conditions will not be exchanged or refunded.

The customer may also return a product purchased with a promotional code or gift card. Once the return is accepted, a credit note will be sent.

Promo codes and gift cards are non-returnable and non-refundable.

Return shipping costs are at the customer's expense. We recommend sending the return with insured tracking and keeping the return receipt. Meelaq is not responsible for the correct routing of the return shipment.

On receipt of the return from the Customer, the condition of the product is examined. When the return is approved, a confirmation e-mail is sent to the Customer. The refund is processed within 10 working days, and a credit is applied to the payment method used to purchase the product. The time taken to receive the refund may vary depending on the Customer's bank.

If the Customer's return is not approved, a refusal e-mail is sent to inform the Customer that the refund request has been rejected and that the product will be returned.

Modification of the site and general terms and conditions of sale

Meelaq reserves the right to update, modify or replace any part of the site.

The customer may consult the most recent version of the general terms and conditions of sale at any time on this page. It is the customer's responsibility to check the site periodically for changes.

Personal data protection

Meelaq ensures that all personal data of its customers is treated confidentially, in accordance with current legislation. No information about our customers is passed on to third parties. The data recorded by Meelaq is used solely for the registration and processing of orders and the administration of customers' personal accounts.

Intellectual property

All elements published on this site, including texts, logos, photographs and drawings, are the exclusive property of Meelaq. Consequently, none of these elements may be represented, reproduced, translated, downloaded, transmitted, sold, exploited commercially or privately without the prior, special and express agreement of Meelaq.

Applicable law

All clauses in these terms and conditions are subject to Swiss law. The exclusive place of jurisdiction is Marin-Epagnier.
